These terms govern your use of McKay Media Co's website and your purchase of our services. By purchasing or using our services, you agree to them. McKay Media Co is a brand of Kristen McKay Photo, a Bangor, Maine business owned and operated by Kristen McKay. Questions: [email protected] or (207) 481-4345.

1. What we provide

McKay Media Co builds and operates done-for-you booking systems and AI agent systems ("agents") for businesses. Systems are installed into your own account and, for services on a monthly plan, operated on McKay Media Co's automation infrastructure and AI accounts.

2. Purchases and billing

Purchases consist of a one-time setup or installation fee and, where stated at checkout, a recurring monthly fee. The monthly fee covers hosting, the automation infrastructure, AI processing, monitoring, and ongoing maintenance that keep your system operating. Prices are as shown at checkout. Founding or promotional pricing may be offered at our discretion and may be conditioned on providing a testimonial.

3. Non-payment and cancellation

If a monthly payment fails and is not resolved after our notices, your system will be paused... nothing will send or post on your behalf until the account is current. You may cancel your monthly plan at any time; your system deactivates at the end of the current billing period. Cancellation never affects ownership of your own account or data (see Section 5).

4. Refunds

Setup and installation fees are non-refundable once the build has begun (beginning with your intake being processed or access to your account being established). Completed installations are final sale. Monthly fees are non-refundable once a billing period has started.

5. Your account and data

Systems are installed into your own accounts. Your account, your contacts, your emails, your social accounts, and everything sent or posted on your behalf are yours, permanently, regardless of your subscription status. You may revoke McKay Media Co's access to your accounts at any time; note that systems on a monthly plan require our infrastructure to operate.

6. Intellectual property

The system architecture, automation designs, prompts, workflows, and related materials remain the intellectual property of McKay Media Co / Kristen McKay. Your purchase grants a license to use the installed system for a single business. You may not resell, redistribute, reverse-engineer for resale, or install the system for other businesses.

7. Your responsibilities

You're responsible for the content you provide to your systems (voice memos, photos, services, prices, and other inputs), for reviewing approval messages before sends where an approval step is provided, and for ensuring your marketing complies with the laws that apply to your business (including email and SMS marketing laws such as CAN-SPAM and TCPA). You confirm that contacts on your lists have an appropriate basis to be contacted.

8. SMS messaging program

McKay Media Co offers an SMS program for customers and leads who opt in through our website form or at checkout. Message types include transactional and informational messages (such as booking confirmations, appointment reminders, approval notifications, scheduling, account notifications, and replies to inquiries) and, where you have separately consented, occasional marketing and promotional messages. Message frequency varies. Consent to receive marketing texts is not a condition of purchase.

9. How to opt out

You can cancel the SMS service at any time by replying STOP to any message. After you send STOP, we will send a confirmation and you will no longer receive SMS messages from us. If you want to rejoin, opt in again through our website form and we'll start sending messages again. Opting out of texts does not affect your services... we'll use email instead.

11. Message and data rates

Message and data rates may apply for any messages sent to you from us and from you to us. If you have questions about your text or data plan, please contact your wireless provider.

12. Carrier liability

Carriers are not liable for delayed or undelivered messages.

13. Age requirement

Our services and our SMS program are intended for individuals 18 years of age or older. By purchasing our services or opting in to receive messages, you confirm that you are at least 18 years old.

Results shown on our website are from Kristen's own business and installations. They are real, and they are not a promise. Your results depend on your list, your offer, your market, and your follow-through. We make no guarantee of specific revenue, bookings, engagement, or other outcomes.

16. Warranties and liability

Services are provided "as is." We work on third-party platforms and are not responsible for their outages, policy changes, or account actions, though we will work in good faith to adapt your systems when platforms change. To the maximum extent permitted by law, McKay Media Co's total liability for any claim related to the services is limited to the amounts you paid us in the three months before the claim arose.

17. Governing law

These terms are governed by the laws of the State of Maine. Any disputes will be resolved in the state or federal courts located in Maine.

18. Changes

We may update these terms; the current version will always be posted here with its effective date. Continued use of the services after changes means you accept the updated terms.
